Getting Started with Performance Appraisals

Here are some things to think about, before you carry out your annual staff appraisals, to make them less daunting and more effective. We’ll go into more details on these tips and what to actually in the appraisal meeting, at our forthcoming workshop on 11 September 2013.

Prepare. A good appraisal form will provide a natural order for proceedings, so use one. If you don’t have a standard appraisal form then find one online – there are plenty of templates available. Organize your paperwork to reflect the order of the appraisal and write down the sequence of items to be covered. If the appraisal form includes a self assessment section and/or feedback section, make sure you give this to each member of staff in plenty of time, allowing them to complete it before the meeting.

Part of your preparation should also consider ‘whole-person’ development, beyond and outside the job skill-set. Many people are not particularly interested in job skills training, but will be interested and motivated by other learning and development experiences. Get to know what your people are good at outside of their work. Appraisals are not just about job performance and job skills training. Appraisals should focus on helping the ‘whole person’ to grow and attain fulfilment.

Inform. Let your staff know when and where their appraisal will be held. Give them the chance to assemble any data and relevant performance and achievement records they need.

Venue. Plan a suitable venue that’s private and free from interruptions. Privacy is absolutely essential.

Layout.  Room layout and seating are important elements as they have huge influence on atmosphere and mood. Irrespective of content, the atmosphere and mood must be relaxed and informal. Remove barriers – don’t sit across the desk from your staff member; use a meeting table or easy chairs and sit at an angle to each other.

Introduction. Relax your member of staff by opening with a positive statement. Smile, be warm and friendly to create a calm and non-threatening atmosphere. Set the scene by explaining what will happen and encourage a discussion and as much input as possible from them

When you spend some time thinking about how you’ll carry out your annual appraisals, they’ll be much more effective for both you and your members of staff.

What Do Employees Want from Appraisals?

Many people have had bad experiences of appraisals, so many employers don’t enjoy carrying them out. However, for your business and your staff to progress, some form of regular appraisal is essential.

If you put yourself in the shoes of your members of staff, you can both get more from your time together. There are five things that your employees need to know at their appraisal:

  • Tell me what’s expected of me – talk to me about goals and expectations so that I can work towards them.
  • Give me the opportunity to perform – give me the chance to take responsibility and let me show you how good I am.
  • Tell me how I’m getting on – if you like what I’m doing, tell me; if you’re concerned about my progress, I need to know that too.
  • Give me support guidance and development – help me to grow and develop by giving me what I need to reach my goals.
  • Recognise my contribution – say thank you to show that you’re grateful for all the hard work I put in.

Legal HR Update July 2013

In June 2013 a number of changes were made to employment law. Here’s a summary of what you need to know.

1. Qualifying period for unfair dismissal claims over political opinions removed

From 25 June 2013, the two year qualifying period for unfair dismissal claims does not apply where the alleged reason for dismissal is, or relates to, the employee’s political opinions or affiliations.

This means that any member of staff who thinks they have been unfairly dismissed due to their political beliefs does not have to have worked for you for at least two years before they can make such a claim.

2. Public interest disclosures no longer required to be in good faith

From 25 June 2013, a disclosure is not protected unless it is, in the reasonable belief of the worker making the disclosure, ‘in the public interest’. Accordingly, an employee who ‘blows the whistle’ about breaches to his or her own employment contract will not normally be protected. The requirement that a protected disclosure must be made in good faith was removed on the same date.

3. Update Service launched by Disclosure and Barring Service (DBS)

From 17 June 2013, the DBS Update Service allows employers to check the status of criminal record checks online.

This means that you can look up the records of potential employees and current employees too.

Unfair Dismissal Claims – Q and A

Here are some common questions about unfair dismissal and my answers to them.

Q – What is unfair dismissal?

A – Dismissals are classed as ‘automatically unfair’, regardless of the reasonableness, if an employee is exercising their rights related to the following:

  • Pregnancy, including all reasons relating to maternity
  • Family reasons, including parental leave, paternity leave, adoption leave or time off for dependants
  • Representative and trade union membership grounds and union recognition
  • Discrimination on the grounds of age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex and sexual orientation
  • Pay and working hours, including the Working Time Regulations, annual leave and the National Minimum Wage.

Q – When is a dismissal fair?

A – Dismissal is normally fair if an employer can show that it is for one of the following reasons:

  • A reason related to an employee’s conduct
  • A reason related to an employee’s capability or qualifications for the job
  • Because of a redundancy
  • Because a statutory duty or restriction prohibited the employment being continued
  • Some other substantial reason of a kind which justifies the dismissal.

Q – How do you dismiss employees?

A – The key points to remember are:

    • Dismissing employees should be the last resort and employers should carry out necessary investigations without unreasonable delay to establish the facts
    • Employers should use a fair and consistent procedure when dismissing employees
    • It’s always best to try to resolve any issues informally first
    • Employees have the right not to be unfairly dismissed
    • Set out in writing your rules and procedures for handling disciplinary procedures
    • Make sure employees and managers understand the rules and procedures for disciplinary issues.

Q – When can an employee make a claim about unfair dismissal?

A – In most circumstances employees will need to qualify before they can make a complaint to an employment tribunal. They need:

  • At least one year’s continuous service for employees in employment before 6th April 2012
  • Two years for employees starting employment on or after 6th April 2012.

Q – How do you avoid costly mistakes?

A – Before thinking about dismissing an employee, stop and think – are you doing the right thing? To make sure that you comply with the law and don’t make any costly mistakes, whether you’re an employee or an employer, get the right advice.

Keep Your Staff Happy to Grow Your Business

When your employees are engaged with your business, you have a much greater chance to grow a profitable business and keep your customers satisfied.

So what makes an engaged employee? How does their engagement affect your business? How can you achieve engagement with your staff?

As an employer you need to create the right environment to allow engagement to flourish in your workforce. To help you get the basics in place, here are four steps to follow:

1. Create a strategic story – Where are you? Where have you been? Where are you going? As a business owner you probably know this, but do your employees feel part of that story? If they know the story, it lets them see how the work they do fits in with the business’s goals. This isn’t something you can simply put on a poster on the wall to get buy in. You need to repeat the story over and over again to employees and give them a sense of ownership in it. If your story is on the wall, ask your staff to add to it; create a timeline of diagrams, new solutions and innovations leading to your company’s goals. Create a buzz and encourage people to share their ideas, so they can see how their achievements fit into your company’s ‘big picture’.

2. Engage managers – If you try to engage your staff without first engaging your managers you may get limited results. Many employees’ motivation and engagement will depend on how they feel towards their bosses. If those managers are not engaged themselves, where’s the motivation to engage their people? Engaged managers focus their people and enable them to get the job done, treat their team members as individuals and coach and stretch them. When your managers build bigger relationships with people as individuals, those workers will make bigger contributions.

3. Give employees a voice – Listening is a key part in giving employees a voice but it doesn’t stop at the 360-degree survey. A survey might tell you how people are feeling at a certain point in time but it doesn’t tell you why they are feeling like that. Members of staff have insights into why and where things are going wrong. Somebody knows before the event that something is going to go wrong. If they know that they can speak up and be listened to, the problem can be pointed out before it becomes a disaster.

Employees who are able to speak up will share the good as well as the bad. If they feel that their ideas are listened to, they’ll share them, which will increase their engagement in their work.

4. Make sure there is organisational integrity – This means avoiding the “do as I say, not as I do” mentality. If your company’s values are not reflected in the day-to-day behaviours of managers or colleagues, then it will be seen as a corporate spin exercise and will not be trusted by employees. When your values are aligned between staff and managers, then trust is created and so is engagement.

Different companies will need to create different engagement programmes, but if you follow these four steps, you’ll be able to create a strong foundation for any efforts you make to increase employee engagement and develop your business.

Formal versus Informal Performance Management

There are two sides to performance management that you need to consider with your staff. There is day to day management and there are the more formal processes, which include issues such as appraisals, setting objectives and setting standards.

Formal management

Many managers don’t like carrying out appraisals and they do have a reputation for being difficult to do and timing consuming. Done without any planning they can actually be a waste of time! However, formal, planned appraisals can be of huge benefit to your business and your staff. It gives you the chance to sit down every year with each member of your team and discuss the important issues with them.

Informal management

Don’t neglect your daily and weekly contact with your staff, thinking that you can leave everything to the annual appraisal. Make sure you keep in communication on a regular basis to iron out any issues that might arise. Don’t let minor issues develop into huge problems by ignoring them! Monitor individual and team performance so that you can give feedback at the appropriate time. Keep giving your staff regular praise and recognition for a job well done.

When you can achieve a balance of formal and informal performance management, that best suits you, your team and your business, you’ll be in the best position to create the best performance.

How do You Deal with Long Term Absence of Your Staff?

A few weeks ago in this blog we looked at how to manage short term absence and the benefits of getting it right. Click here to read that post. In this one, we’re looking at long term absence.

Long term absence is generally more than four weeks. It needs active management of the absence and your employee’s return to work, so that you can plan ahead and organise work and temporary cover. When you’re dealing with long term absence you should regularly review progress in a way your employee is comfortable with. Ask them whether they prefer contact by phone, email, or home visits.

When making contact with them you can discuss:

  • How long they’ve been away
  • How they are feeling and whether they feel ready to return
  • If there is anything you can do to help.

Keeping in touch and remaining constructive, supportive and open to addressing their concerns about returning to work makes your employees feel cared for and valued.
Long term illness requires medical involvement to assess the effects of your employee’s condition, the likely duration of their time off and whether you can take steps to help their return to work.

Long Term Sick Leave leading to Dismissal

Hopefully, if you keep speaking to your member of staff about their illness and absence, it won’t come to this. You need to consider and discuss all the options with your employee before arriving at this conclusion. If you do reach this stage, you need to show that the absence was sufficient for the employee’s recovering and that fair procedure has been followed, in order to justify dismissing them. It should be a last resort.

Whatever happens, here are three things you should do:

  • Monitor – you don’t know if you don’t ask and you won’t remember unless you record it
  • Talk, talk, talk to your employee to offer support
  • Get medical advice – you’re not expected to be the expert.

How do you deal with long term absence? What issues have you had and how have you dealt with them?

Promotion – Are They Really Ready for It?

You’ve got a great salesman working for you. He’s been with your business for some time and knows the company inside out. He knows all about your products and services and does a great job selling them. You have other members of the sales team who aren’t doing as well and who could learn a lot from this person. So you decide to promote him to Sales Manager. This way, he can lead the rest of the sales team, sharing his knowledge and experience with them. He can inspire them and help create a great sales department.

However, a few months after his promotion, you notice that things are not quite going to plan. Why is this? It is something that’s seen over and over again in companies where someone has been promoted because they’re good at what they do. They end up managing other people and not doing a very good of it. This is often because they have had no management training; they don’t know how to manage other people who are doing what they used to do.

Great salesmen – and many other professions – are good at the technical side of their jobs. They’re not necessarily natural people people.

So what do you do if it goes wrong?

Always start with a probationary period, to give you the chance to review the performance of your new manager

If it’s still not working out:

  • Give them a full opportunity to any discuss problems with their job
  • You’re under no obligation to give them their old job back, but you can discuss it, if it’s still vacant
  • Consider an alternative position before dismissal; tribunals will want you to consider all alternatives before you let someone go.

Before you promote someone to management level, take the time to find out if they are really ready for it. If not, what do you need to do to make them ready to make them into great managers?

Don?t Make a Pantomime Out of HR

Here’s a little festive tale of HR for you, called the Cinderella School of HR.

Cinderella doesn’t like having to work long hours in the run up to Christmas, and drop everything every time her step mother wants something. She prefers being able to work flexible hours, as she knows what she needs to get done. Helping her identify ways of improving her work/life balance makes her much more engaged with her work.

The Ugly Sisters spend a lot of time telling poor Cinders what to do. They find fault with everything that she does and yet they never lift a finger to help. Why do they pick on their step-sister in this way? Because they’ve both realised that they’re not reaching the objectives that were set at their last appraisals – they’re both underperforming! Making Cinderella look bad means that their mother won’t notice how useless they are. Perhaps they need the Fairy Godmother to carry out their next appraisals and see what needs to be done?

Prince Charming used to be far from charming. He was always doing his own thing, despite having been told what to do on numerous occasions. He turned up late for princely duties; he didn’t send his reports back to the office promptly, so Buttons couldn’t get the invoices out on time. The Fairy Godmother was called in to see if young Charming could be sacked. Instead she suggested a capability meeting, where she explained the concerns and set some goals for Charming to achieve in time for another meeting in two weeks. The King called back just a week later to say that Charming had suddenly become utterly charming and was in fact now the best Prince that the King had ever known. All that from one meeting!

So if Cinderella doesn’t seem pleased to be at work, ask her what you can do to improve her work/life balance.

If you’ve got Ugly Sisters not meeting their targets, or Princes not being charming, instead of trying to get rid of them, talk to them about how you can improve their performance and wave your magic wand! You could be surprised by the results. Oh yes you could!

What’s the Best Way to Deal with Underperforming Staff?

In a recent blog post I introduced you to Heather, who was receiving poor performance feedback. Click here to read about Heather . Did you have any solutions for her?

Here are our suggestions.

While Heather has a lot of experience developing training courses, she’s not getting good feedback from delivering them. The cause of this could be that she:

  • Only likes writing courses and not the delivery
  • Has been given the delivery, when it wasn’t originally part of her job
  • She doesn’t have the confidence in delivery of the information when asked questioned
  • She thinks she’s being challenged when someone asks her a question.

How can we help Heather?

First it is important to acknowledge Heather’s strengths – her knowledge and ability to write training courses. Then we need to find out what she thinks about the feedback she’s getting and how she feels about the delivery of the courses. Does she enjoy that part of the job? If so, we can help her build up her confidence. Has she had any training in presentation skills? If not and she wants to continue with the delivery, we can look at the right training to help her.

In situations like this, it’s important to hear all the sides of the story, before rushing to any conclusions or imposing a solution. Work with your members of staff to find the best outcome for both of you.
